BirgerMind Hosting Agreement and Security Policy
Effective Date: 17.12.2024
1. Parties
This Hosting Agreement is made between:
- Service Provider: BirgerMind SIA, Reg. No. 40203367081, registered in the Republic of Latvia, with legal address at Peldu 35A-5, Liepaja, LV-3401, Latvia (hereinafter "Provider")
- Client: The natural or legal person ordering hosting services (hereinafter "Client")
2. Scope of Services
Provider shall deliver secure High-Availability (HA) hosting services, virtual machine creation, and optional GPU resources as per the selected plan.
3. Compliance and Legal Use
- Client must comply with all laws of Latvia, the EU, and relevant jurisdictions.
- Client is solely responsible for hosted content and services.
- Prohibited uses include:
- Illegal content (e.g. child abuse, malware)
- IP rights violations
- Unauthorized access or network attacks
- Terrorist activity
- Other unlawful behavior
4. Limitation of Liability
- Provider is not liable for unlawful use by Client.
- Client bears all legal and financial responsibility for misuse.
- Client covers costs related to investigations, damages, or seizures.
5. Security and Incident Responsibility
- Provider maintains physical and software-level security.
- Client is responsible for securing VMs, access, and configurations.
- Provider is not responsible for breaches due to client-side errors.
6. Indemnification
Client agrees to indemnify the Provider from claims, legal fees, or actions arising from misuse or hosted content.
7. Suspension and Termination
- Provider may suspend or terminate service for violations or abuse.
- No refunds for misconduct-related termination.
8. Data Protection and Privacy
- Provider complies with GDPR.
- Client is responsible for lawful data processing within their services.
9. Jurisdiction
Governed by laws of the Republic of Latvia. Disputes resolved in Latvian courts.
10. Final Provisions
- Binding upon ordering or using the service.
- Provider may update the terms with notice.
- Use implies acceptance of latest version.
By ordering or using BirgerMind hosting services, the Client confirms agreement to these terms.
